These Terms of Service (“Terms”) govern your access to and use of VibeBoy (the “Service”), a web-based coding and game-creation platform offered by CircuitMess, Inc. (“CircuitMess,” “we,” “us,” “our”), operated at vibeboy.vercel.app.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility, Accounts, and Parental Consent
VibeBoy is designed for children and teens. Specific rules apply depending on age:
- Users under 13. A parent or legal guardian must create the account, agree to these Terms on the child’s behalf, and consent to the collection and use of the child’s information as described in our Privacy Policy. The parent or guardian is responsible for the account and all activity on it.
- Users 13–17. A parent or legal guardian must consent to the user’s creation of an account and to these Terms. The parent or guardian is responsible for purchases made on the account.
- Users 18+. You may create an account in your own right.
You agree to provide accurate information when creating an account, keep your login credentials secure, and notify us promptly of any unauthorized access. We may suspend or terminate accounts that violate these Terms or that we suspect are involved in fraud or abuse.
3. The Service
VibeBoy provides tools for children and teens to create games using an AI coding assistant, share their creations, and learn programming concepts. Specific features, limits, and content available on the Service are described on the relevant pages of the site and may change over time.
We may add, modify, or remove features at any time. We will use commercially reasonable efforts to provide notice of material changes that affect paid subscriptions.
4. Subscriptions, Billing, and Cancellation
VibeBoy offers a free tier and paid subscription plans (“VibeBoy Pro”) at the prices shown on the /pricing page. Subscription terms:
- Auto-renewal. Subscriptions automatically renew at the end of each billing cycle (monthly or annual) at the then-current rate, until cancelled.
- Cancellation. You may cancel anytime through the subscription management portal accessible from your account page. Cancellation stops future renewals; access continues through the end of the current paid period.
- Refunds. Refund eligibility is described in our Refund Policy.
- Price changes. We may change subscription prices. Changes apply to renewals after the change takes effect; we will notify active subscribers at least 14 days before the change.
- Taxes. Prices may be subject to tax depending on your location. Applicable taxes are calculated at checkout.
- Payment processing. Payments are processed through Shopify Payments. We do not store full payment card details.
5. License to Use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license is for one (1) individual user; you may not sell, gift, or share your login credentials. We may detect and act on account sharing, including terminating access without refund.
6. Acceptable Use
You agree not to:
- Copy, reproduce, distribute, sell, sublicense, or create derivative works of VibeBoy itself, except as expressly permitted;
- Circumvent access controls, scrape, hack, or interfere with the Service’s operation;
- Upload malware, exploits, or harmful code;
- Harass, threaten, bully, or harm other users, or post unlawful, infringing, hateful, sexually explicit, or violent content;
- Attempt to use VibeBoy to generate content that sexualizes minors, promotes self-harm, or violates any applicable law;
- Use the Service to build a competing product or to train another AI model without our express written consent;
- Misuse or attempt to manipulate the AI assistant to produce content that violates these Terms or our content policies.
7. Intellectual Property
All elements of the Service that we provide — including the VibeBoy software, runtime, AI tooling, design, branding, sample games, sounds, sprites, and documentation — are owned by CircuitMess or our licensors and are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.
8. User-Generated Content (Your Games)
VibeBoy lets you create games and other content (“Your Content”). As between you and CircuitMess:
- You retain ownership of Your Content.
- You grant us a license to host, store, display, back up, and otherwise use Your Content as needed to operate the Service for you (for example: saving your draft, letting you play your game, syncing across devices).
- If you publish Your Content publicly (for example, to a public gallery, leaderboard, or community feed), you grant us and other users a worldwide, royalty-free, non-exclusive license to access, play, share, and remix Your Content within VibeBoy. You can unpublish at any time, which stops new public access; copies that others legitimately accessed before unpublishing may persist.
- You represent that you have the right to submit Your Content and that it does not violate any third-party rights or these Terms.
- We may remove Your Content if we reasonably believe it violates these Terms, our content policies, or applicable law.
9. AI-Generated Output
VibeBoy uses artificial intelligence (currently provided by Anthropic) to help users write code and create games. You acknowledge:
- AI-generated output may be incorrect, incomplete, biased, or unexpected. Output should not be relied on for any safety-critical, medical, legal, or financial purpose.
- AI-generated output is provided to you to use within the Service. To the extent we have rights in AI-generated output that is delivered to you, we assign those rights to you, subject to these Terms and our continuing rights in the underlying VibeBoy platform.
- Other users may receive similar or identical AI-generated output. AI output is not exclusive to you.
- We recommend that a parent or guardian supervise younger users when interacting with the AI assistant.
10. Third-Party Services and Links
The Service relies on third-party services (including, without limitation, Anthropic for AI, Shopify for payments and subscription billing, Google for authentication and cloud storage, and Vercel for hosting). Your use of those services may be subject to their own terms. We are not responsible for third-party services or their practices.
11. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law:
- We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components.
- Educational and AI-generated content is for informational purposes only and is not a substitute for professional advice.
- We do not guarantee any specific learning outcome.
12. Limitation of Liability
To the fullest extent permitted by law, CircuitMess and our officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service.
Our total aggregate liability for claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD 50.
Some jurisdictions do not allow certain exclusions or limitations of liability; in such jurisdictions, our liability is limited to the minimum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless CircuitMess from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of another, or content you submit to the Service.
14. Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you violated these Terms or if required to protect the Service or others. You may stop using the Service and cancel your subscription at any time. Sections of these Terms that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law).
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in these Terms limits any non-waivable rights you may have under the law of your country of residence.
16. Changes to These Terms
We may update these Terms from time to time. The “Effective date” above will reflect when changes take effect. For material changes, we will provide reasonable notice (for example, by email or in-app notice) before the change applies to existing accounts. Continued use of the Service after the effective date means you accept the updated Terms.
